For ease of reading, these Terms and Conditions use the masculine form, so it is to be considered gender-neutral and inclusive of all genders.

The provider conducts events, workshops, trainings, mentoring, coaching, programs, seminars, and retreats in accordance with these General Terms and Conditions (GTC). By commissioning, purchasing, and/or booking any of the services, the client accepts these terms. These GTC apply to all offers from My Yogic Journey, regardless of location, time, or type of execution, unless otherwise specified in individual contracts.

These General Terms and Conditions govern all legal relationships between the sole proprietorship My Yogic Journey, Hügelstraße 1, 61194 Niddatal, Germany (hereinafter referred to as "My Yogic Journey") and the contractual partner. They apply to both consumers and businesses, unless a distinction is made in the relevant clause.

3.1 Payment must be made in advance unless otherwise agreed in writing. The date of payment is determined by the date the amount is received by My Yogic Journey.

3.2 Available payment methods are “invoice,” “direct debit” (SEPA), “credit card,” “bank transfer,” and “PayPal.”

3.3 Discounts are only binding if they have been confirmed in writing by My Yogic Journey.

3.4 My Yogic Journey reserves the right to change the payment service provider. No separate notice of the change will be issued. Any existing authorizations will transfer to the new provider. No additional consent for data transfer is required.

4.1 All materials provided to the client are included in the agreed fee unless otherwise specified. These materials are intended for the client’s personal use only.

4.2 Das Urheberrecht an den Konzepten und Unterlagen gehört allein dem Anbieter. 4.2 Copyright to concepts and materials belongs exclusively to the provider. Photographs, quotes, poems, workbooks, educational materials, and the learning platform used are protected by copyright. The client is not permitted to reproduce or share the materials, in whole or in part, with third parties without prior written consent. Any form of publication, even partial, is strictly prohibited. Dem Klienten ist es nicht gestattet, die Unterlagen ohne schriftliche Zustimmung ganz oder auszugsweise zu reproduzieren und/oder Dritten zugänglich zu machen. Eine Veröffentlichung, auch auszugsweise, ist untersagt.

Personal data is stored and processed electronically by the provider solely for the purpose of event and contract management (see data protection notice at www.myyogicjourney.de). Confirmation of participation may be sent via unencrypted email, and it cannot be ruled out that it may be accessed by third parties. For events conducted in cooperation with partners, only the personal data required for contractual purposes will be forwarded to the respective partner. www.myyogicjourney.de). Die Übersendung der Teilnahmebestätigung kann auch per unverschlüsselter E-Mail erfolgen. Dabei kann nicht ausgeschlossen werden, dass diese von Dritten gelesen wird. Bei Veranstaltungen, die durch Kooperationspartner durchgeführt werden, werden nur die personenbezogenen Daten an den Kooperationspartner weitergeleitet, soweit dies für den Vertragszweck erforderlich sind.

The provider agrees to maintain confidentiality regarding all business, operational, and personal matters of the client that become known during the course of the engagement, even after the contract has ended. Additionally, the provider agrees to handle all documents provided for the purpose of consultancy with care and to protect them from unauthorized access.

7.1 The provider is only liable for damages resulting from intentional or grossly negligent breaches of duty by the provider, their legal representatives, or agents. Liability for injury to life, body, and health, for the breach of essential contractual obligations, and those under the Product Liability Act remain unaffected. The provider assumes no liability for items brought by users, especially valuables or clothing. Essential contractual obligations are those that are necessary to achieve the purpose of the contract and on which the contractual partner may regularly rely. In the event of a breach of essential contractual obligations due to slight negligence, liability is limited to the foreseeable, typical damage, unless the damage relates to life, body, or health.

7.2 Liability for damages—regardless of legal grounds, particularly for impossibility, delay, defective performance, breach of contract, breach of duties during contract negotiations, and tort—is limited to intent and gross negligence, insofar as fault is required. This does not apply to damages arising from injury to life, body, or health.

8.1 My Yogic Journey reserves the right to change these General Terms and Conditions at any time.

8.2 If changes are made, the customer will be informed in text form. The changes shall be deemed accepted unless the customer objects in writing within four weeks of being notified.

9.1 The legal relationship between My Yogic Journey and the customer is governed by the laws of the Federal Republic of Germany.

9.2 For consumers, the place of jurisdiction is their place of residence.

B1.1 General

B1.1.1 My Yogic Journey reserves the right to reject individual client requests without stating reasons.

A1.1.2 The client is solely responsible for ensuring the technical requirements necessary to participate in the agreed service and must bear any associated costs.

B1.1.3 Information provided by My Yogic Journey digitally and for a limited time can be accessed via the internet. The content may be made available in various formats (e.g., texts sent by email, presentations, PDF documents, or videos). Saving this content for permanent use ("download") is not permitted. Access to this content is granted only for the duration of the contractual relationship.

A1.2 Self-Responsibility of the Participant

A1.2.1 Yoga and breathwork classes are conducted by My Yogic Journey to the best of its knowledge and belief. These classes serve health promotion and prevention purposes, are not intended to achieve medical healing, and do not replace medical consultations. Participants are expected to have self-responsibility and normal physical and psychological resilience. If any physical or mental limitations exist, the client is required to consult a doctor before participating.

A1.2.2 If the participant has doubts regarding their health suitability, medical advice must be sought prior to the session. In the case of pregnancy, high blood pressure, diabetes, heart conditions, recent surgical scars, asthma, back pain, depression, or similar, consultation with the yoga or breathwork instructor before the session is required.

A2.1 The written contract (ticket purchase and/or confirmed booking of an offer), including these General Terms and Conditions, solely governs the legal relationship between My Yogic Journey and the client. This document contains the full agreement between the parties. Any prior verbal statements made by My Yogic Journey are not legally binding. Any verbal agreements are superseded by the written contract.

A2.2 Purchasing a ticket for a specific event grants participation in that specific event only and is non-transferable.

A2.3 A confirmed booking is valid for one-time participation in the booked offer only and is non-transferable.

A3.1 Registration can take place via direct ticket purchase or written confirmation. In the case of written registration, it is only binding if payment is received in My Yogic Journey’s account within 5 business days. If no payment is received, My Yogic Journey reserves the right to allocate the place to another participant.

A3.2 Unless otherwise agreed, the cancellation policy for events, courses, workshops, programs, and retreats is as follows: Veranstaltungen, Kurse, Workshops, Programme, Retreats lauten sofern nicht anders vereinbart wie folgt:

• Cancellation up to 2 weeks before the event: 100% refund.
• Cancellation within 2 weeks before the event: Full fee is due, unless a substitute participant is provided.
• Rebooking or sending a substitute participant is free of charge up to 3 days prior to the event.
• No-shows will be charged the full fee.
• For online courses, no withdrawal is allowed once content has been downloaded or used.

Cancellations or rebookings must be made in writing. The date of receipt is decisive.

A3.3 My Yogic Journey may cancel an event at any time for good cause (e.g. insufficient participants, illness, or unavailability of the instructor). In such cases, the full event fee paid will be refunded. Further claims (e.g. for travel or accommodation expenses) cannot be made.

A4.1 Dates for events, programs, workshops, and retreats provided by My Yogic Journey are always approximate unless a fixed date is explicitly confirmed. My Yogic Journey reserves the right to make changes to the schedule, instructors, or content. No refunds will be issued for these changes.

A4.2 For events with a limited number of participants, places will be allocated on a first-come, first-served basis. In the case of overbooking, alternatives may be offered. 

A4.3 In the event of underbooking (fewer than 3 participants), My Yogic Journey reserves the right to cancel the event.

A4.4 My Yogic Journey is not liable for the impossibility of performance or delays due to force majeure or other unforeseeable events at the time of booking that are beyond its control.

My Yogic Journey reserves the right to cancel an event for good cause, including but not limited to an insufficient number of participants, the sudden unavailability of a trainer/mentor/coach, or force majeure. The client will be informed without delay, and alternative dates will be sought. If no alternative can be found, the client will receive a full refund of any fees paid. Further claims (e.g. for travel or accommodation) are excluded.

B1.1 Allgemein

B1.1.1 My Yogic Journey behält sich vor, einzelne Anfragen von Kunden ohne Angaben von Gründen ablehnen zu können.

B1.1.2 Der Kunde ist für sämtliche technische Voraussetzungen, die für die Teilnahme an der vereinbarten Leistung erforderlich sind, selbst verantwortlich und hat entsprechende Kosten zu tragen.

B1.1.3 Informationen, die digital und zeitlich begrenzt durch My Yogic Journey zur Verfügung gestellt werden, können über das Internet abgerufen werden. Die Inhalte können dabei in verschiedenen Formen bereitgestellt werden (z.B. Texte, die per E-Mail versendet werden, Präsentationen, PDF-Dokumente oder Videos). Das Speichern der Inhalte zum dauerhaften Besitz (“Download”) ist untersagt. Der Zugang zu diesen Inhalten ist dem Kunden nur während der Dauer des Vertragsverhältnisses gestattet.

B1.2 Limitations and Distinction from Psychotherapy

B1.2.1 My Yogic Journey explicitly states that its services are intended only for individuals in a stable mental condition. These services do not replace psychotherapy and are solely designed to support preventive mental well-being.

B1.2.2 Distinction from Psychotherapy: Coaching / mentoring / consulting is not therapy and does not replace it. It is based on a client-provider relationship characterized by collaboration and is clearly distinguished from therapeutic or medical services. Psychotherapy is problem- and symptom-oriented. Coaching / mentoring / consulting is solution-focused and geared toward present and future action. Psychotherapy treats mental illness; coaching / mentoring / consulting serves mentally healthy individuals capable of taking action and self-refelction. Its aim is not symptom relief, but personal development and enhancement of quality of life.

B1.2.3 Client Participation: Coaching / mentoring / consulting is based on preparatory conversations between both parties. It relies on mutual trust and cooperation. It is a free, active, and self-responsible process. No specific results are guaranteed. The provider supports the client during decision-making and change processes, but the actual change must be carried out by the client. The client should therefore be willing and open to engage with themselves and their situation.

B2.1 Unless otherwise agreed, all concluded agreements are service contracts. The subject of the agreement is the delivery of the agreed services, not the achievement of specific results. Statements and recommendations help guide the client’s decisions, but do not replace them.

B2.2 A free initial consultation takes place before the contract is concluded. Registration is only possible after a qualification conversation.

B2.3 A contract can be concluded through verbal confirmation by the client following the initial conversation. The booking will then be confirmed via email. The representation of the service on the website (https://myyogicjourney.de) does not constitute a legally binding offer. Registration is only valid after a qualification conversation. 

B2.4 Unless otherwise agreed, the contract term begins with the confirmation of the binding registration and ends upon completion of the coaching or consulting service.

B2.5 My Yogic Journey reserves the right to reject contract offers without giving reasons.

B3.1 All offers are subject to change. All fees are quoted in euros and depend on the agreed services. Die Höhe der Kosten richtet sich nach der vereinbarten Leistung.

B3.2 Appointments are agreed upon by both provider and client. All scheduled appointments are binding, including free preliminary sessions.

B3.3 Cancellations or rescheduling of 1:1 sessions are free of charge up to 78 hours before the appointment. After this period, 100% of the fee is due. No-shows are fully charged.

B4.1 Withdrawal is free of charge within 14 days after the contract is concluded. If the service has already been used, the right of withdrawal is forfeited. For business clients, consumer protection laws do not apply, and the full service fee must be paid.

B4.2 Scheduling: Individual coaching or breathwork sessions are scheduled in advance and confirmed in writing (e.g. via email or an online booking system).

B4.3 Cancellation by the client: Sessions can be cancelled or rescheduled free of charge up to 72 hours before the agreed appointment. Later cancellations or no-shows are fully charged, and paid sessions are forfeited. Exceptions (e.g. illness with proof) may be granted on a case-by-case basis, but there is no entitlement to them.

B4.4 Cancellation by the provider: If a session must be canceled by the provider (e.g., due to illness or technical issues), an alternative appointment will be offered. If this is not possible or not desired, any amount already paid will be refunded in full.

B4.5 Technical requirements for online sessions: The client is responsible for ensuring a stable internet connection and a functioning device with camera and microphone at the time of the session. If the session cannot take place due to technical issues on the client’s side, it is considered a short-notice cancellation. If technical issues are on the provider's side, an alternative date will be offered.

B4.6 Termination of ongoing coaching agreements: For booked packages or long-term agreements (e.g., 5- or 10-session packages), the client may cancel at any time with 7 days’ notice before the next scheduled appointment. Services already rendered will be charged proportionally. Overpayments will be refunded. If cancelled on short notice (less than 7 days), the next session will be fully charged unless there is a valid reason.

B4.7 Both parties retain the right to extraordinary termination for good cause. My Yogic Journey reserves the right to exclude participants from sessions for valid reasons, including repeated disruption, inappropriate behavior, failure to respond to a payment reminder, or copyright infringement. In such cases, the client is not entitled to a refund.

If you are a consumer, you have a legal right to withdraw from this contract within 14 days without giving any reason. To exercise this right, you must notify My Yogic Journey via letter or email. Sending the withdrawal notice before the 14-day period expires is sufficient.

If the service has already been used, this constitutes a waiver of the right of withdrawal.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments received from you immediately and no later than 14 days after we receive your notice. The refund will be made using the same payment method as the original transaction, unless another method has been agreed. No fees will be charged for the refund.

B6.1 Jeder Klient trägt die volle Verantwortung für sich und seine Handlungen innerhalb und außerhalb der Coaching- bzw. Beratungssitzung und kommt für eventuell verursachte Schäden selbst auf. Das Coaching ist keine Psychotherapie und kann diese nicht ersetzen. Die Teilnahme setzt eine normale psychische und physische Belastbarkeit voraus.

B6.2 Bei Unternehmen, Vereinen oder ähnlichem ist der Veranstalter von Team-Coachings, Seminaren, Workshops, Kursen usw. immer der Klient. Die Teilnehmer haben deshalb keinen Versicherungsschutz durch den Anbieter.
